MCA V3

Ministry of Corporate Affairs (MCA)

Earlier known as the Department of Company Affairs in 1950, then renamed as Ministry of Commerce till 2004. It acquired the name Ministry of Corporate Affairs (MCA) in 2007 which is still in continuance. 

The Government of India has created this department to manage different business with respect to company administration. Under Government of India (Allocation of Business) Rules 1961, following subjects are assigned to MCA:-

  1. Administration of Companies Act 2013/1956
  2. Administration of the Companies (Donation of National Funds) Act, 1951
  3. Administration of the Monopolies and restrictive Trade practices Act, 1969 (Only residual matters)
  4. Professions of Accountancy (The Chartered Accountants Act 1949), Profession of Costs Accountants (the Cost Accountants Act 1959), Profession of Company Secretaries (The Company Secretaries Act 1980)
  5. Collection of Statistics with respect to companies
  6. Legislation relating to law of partnership and exercise of certain functions under Chapter VII of Indian Partnership Act, 1932
  7. The responsibility of the centre relating to matters concerning centrally administered areas.
  8. Legislation regarding Registration of Societies under Societies Registration Act 1860
  9. Competition Commission of India
  10. Serious Fraud Investigation Office
  11. Administration of Investor Education and Protection Fund Authority
  12. Administration of Insolvency and Bankruptcy Code 
  13. Action Plan for Champion Services Sector 

 

Evolution to MCA V3

MCA has upgraded from MCA V2 i.e. version 2 to MCA V3 i.e. version 3 in which the ministry has introduced enhanced features to facilitate more participation of its stakeholders in form filing. Previously in version 2 eforms were introduced and following procedure was followed :

 

  1. Downloading eform form from MCA website
  1. Filling in details in eform
  1. Attaching DSC of respective director and/or professional
  1. Uploading eform from respective V2

   

Under version 3 “web based eform” has been introduced which will eradicate downloading of efrom rather forms will be filled online through MCA portal thereafter DSC of respective director and/or professional will be attached to upload on MCA portal.

 

Further Version 2, there was only “My Workspace” which had a list of notices and circulars issued by them but in Version 3, there is personalised “My Application” feature which allows one to view all the forms filed by them till date along with the status of the form such as pending for DSC upload, under processing, pay fees, resubmission etc.

User and Registration

  1. Who can be a user in V3?

A user can be a registered user or business user.

  1. What can a registered user do?

Registered user can only perform 2 functions in the LLP module - RUN Form and FILLIP form

  1. Who can be a business user in V3?

A business user can be any of the following :-

  • Company/LLP
  • Directors/Designated Partner
  • Manager/Secretary/Authorised Representative 
  • Officer in Default 
  • Professional/Professional Staff Member

However the “Professional User” in V3  was earlier termed as “Practicing Professional” in V2 portal and professional staff member can be his/her trainee or non trainee. 

  1. In case you are an existing user under V2?

For an existing user, one is not required to register again as the portal will identify the id as duplicate id and not permit a registration once again. But if you attempt to register with a new mail id which was not registered in V2, you will be created as new user 

Special introductions under MCA Version 3

When any DSC is attached to any web based form under V3 the director or professional will get an automated message from the Ministry regarding his/her usage of DSC in that particular form. This will increase the accountability of users and stakeholders will be informative regarding their role.
