IPR Benefits under DPIIT registration

DPIIT-Recognised Startups Are Eligible For The Following Benefits:

DPIIT-Recognised Startups may apply to the Inter-Ministerial Board (IMB) for the following

  • Relaxation in Public procurements norms
  • Section 54GB: Capital gain on transfer of residential property
  • Startup India Seed Fund Scheme (SISFS)
  • Self-certification under Labour & Environment laws
  • Section 79: Carry forward and set off of losses
  • Section(56)(2)(viib)
  • Fund of Funds for Startups (FFS)
  • Sections 156, 191 and 192: Deferment of tax liability on ESOPs

 

Intellectual Property Rights:

Startup India aims to raise awareness and encourage startups to embrace Intellectual Property Rights (IPRs), while also providing support in safeguarding and monetizing their IPR assets. To achieve this, Startup India offers access to top-notch intellectual property services and resources, which include:

Accelerated processing of patent applications for startups

The patent applications submitted by startups receive expedited examination and disposal. This streamlined process is particularly advantageous for startups recognized by the Department for Promotion of Industry and Internal Trade (DPIIT).

 

Rebate on Application Filing:

Startups receive a substantial 80% rebate on patent filing fees compared to other companies, reducing the cost from INR 8,000 to just INR 1,600. This significant reduction in expenses allows startups to effectively manage their finances during the initial stages of their journey. Additionally, a 50% rebate is provided for trademark filing fees, reducing the cost from INR 10,000 to INR 5,000 in comparison to other companies. This financial support further assists startups in minimizing costs associated with protecting their intellectual property assets.

 

Panel of Facilitators for IP Applications:

A dedicated panel of facilitators is available to offer comprehensive guidance on various Intellectual Property Rights (IPRs) and provide information regarding the protection and promotion of IPRs in foreign countries. The Central Government assumes the responsibility of covering the facilitators' fees for any number of patents, trademarks, or designs. Startups are only required to cover the cost of the applicable statutory fees, while receiving invaluable assistance from the facilitators. Their expertise ensures startups have access to necessary support and information throughout the IP application process.

 

Fast-tracking of Startup Patent Applications: 

To expedite the realization of their value, patent applications filed by startups will undergo accelerated examination, ensuring a quicker processing time.

 

Panel of Facilitators to Assist in IP Applications: To ensure effective implementation of the scheme, the Controller General of Patents, Designs, and Trademarks (CGPDTM) will establish a panel of "facilitators." These facilitators will be responsible for providing general advisory services on various intellectual property matters and offering information on protecting and promoting intellectual property in international markets. The conduct and functions of these facilitators will be regulated by the CGPDTM.

 

Government to Cover Facilitation Costs: Under this scheme, the Central Government will assume the financial responsibility of covering the fees of the facilitators for any number of patents, trademarks, or designs that a startup may file. Startups will only need to bear the cost of the statutory fees applicable to their applications.

 

Rebate on Application Filing: Startups will be eligible for an 80% rebate on patent filing fees compared to other companies. This substantial rebate will assist startups in reducing costs during their crucial early years of operation.
